These Terms & Conditions (“Terms”) govern your use of Daily Walls (previously BingWalls) on Android. By downloading, installing, or using the app, you agree to these Terms.

1. App identity and service

Daily Walls is a wallpaper utility app that fetches and displays wallpaper content and related metadata through app and third-party services. The app may be ad-supported and may offer optional in-app purchases.

2. License to use

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial use.

You may not:

  1. copy, modify, or redistribute the app except as permitted by law,
  2. reverse engineer, decompile, or attempt to extract source code (except where legally allowed),
  3. use the app in a way that harms the service, other users, or infrastructure.

3. Content and intellectual property

The app may display wallpaper images and metadata sourced from third parties (including Bing and app backend services). Rights in such content remain with their respective owners.

Your use of content through the app does not transfer ownership rights to you.

4. Accounts, authentication, purchases, and refunds

Some features (such as restore or purchase validation) may require sign-in and/or billing data.

In-app purchases are billed and processed by Google Play Billing and are subject to Google Play terms, billing rules, and refund policies. We do not directly process card payments for in-app purchases made through Google Play.

Refunds, cancellations, and chargebacks for Google Play purchases are handled according to Google Play policies and Google’s billing support process. Purchase status, entitlement, and restoration may depend on third-party platform records and backend validation.

5. Ads and third-party services

The app integrates third-party services (including Firebase services, AdMob, Google Sign-In, and Google Play Billing). Your use of those integrations is also subject to the relevant third-party terms and policies.

6. Connectivity and device responsibilities

Certain features require internet access. You are responsible for your network/data charges, roaming charges, and device conditions (including power, compatibility, and system settings) required for app functionality.

7. Availability and changes

We may update, modify, suspend, or discontinue features (or the app itself) at any time, including for maintenance, security, legal, or product reasons.

We may also update these Terms from time to time. Updated Terms become effective on the date shown at the top of this page.

8. Acceptable use and restrictions

You agree not to use the app for unlawful, abusive, fraudulent, or security-harming activity, including attempts to interfere with app operation, backend services, notifications, or billing flows.

9. Disclaimers

The app is provided on an “AS IS” and “AS AVAILABLE” basis to the extent permitted by applicable law. To the fullest extent permitted under applicable law, we disclaim all warranties and conditions, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee uninterrupted availability, error-free operation, or that all content will always be accurate, complete, or current.

10. Limitation of liability

To the maximum extent permitted by law, Akash Dev will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, or goodwill arising from use of (or inability to use) the app.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Termination

These Terms remain in effect until terminated. We may suspend or terminate access to the app if you violate these Terms or if required for legal, security, or operational reasons.

You may stop using the app at any time by uninstalling it.

On termination, your right to use the app ends immediately. Provisions that by nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution/governing law) will continue to apply.

12. Indemnity

You agree to defend, indemnify, and hold harmless Akash Dev from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the app, your violation of these Terms, or your violation of any law or third-party rights.

If you believe content accessible through the app infringes your copyright or other intellectual property rights, please send a notice with:

  1. your full name and contact information,
  2. identification of the work/right claimed to be infringed,
  3. sufficient details/URL/screenshot to identify the allegedly infringing material,
  4. a statement of good-faith belief that the use is unauthorized,
  5. a statement that the information in the notice is accurate.

We may remove or restrict access to reported material where appropriate and as required by applicable law.

14. Governing law and dispute resolution (India)

These Terms are governed by the laws of India.

If a dispute arises, parties will first attempt a good-faith resolution by written notice. If unresolved within 30 days, the dispute will be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Patiala, Punjab, India. The arbitration will be conducted in English by a sole arbitrator.

Subject to the arbitration clause and applicable law, courts at Patiala, Punjab, India will have jurisdiction for interim relief, enforcement, or matters that cannot be arbitrated.
